Note that Section 15 of these Terms contains a mandatory arbitration provision that requires Local Beef Club and you to use binding arbitration on an individual basis and limits the remedies available to Local Beef Club and you in the event of certain disputes. By agreeing to these Terms, Local Beef Club and you are giving up our rights to bring our disputes before a jury or as a member of a class action.
1. ACCEPTANCE OF TERMS
Welcome to Local Beef Club LLC ("Local Beef Club," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at localbeefclub.com (the "Site") and all related services (collectively, the "Services").
By accessing or using the Services, purchasing Beef Credits, or placing an order, you agree to be bound by these Terms and our Privacy Policy (available at localbeefclub.com). If you do not agree to these Terms, you may not access or use the Services.
Local Beef Club reserves the right to change or modify these Terms at any time and in our sole discretion. If we make material changes to these Terms, we will provide notice of such changes, such as by sending you an email notification or providing notice through the Site. By continuing to access or use the Services after such notice has been provided, you confirm your acceptance of the revised Terms. We encourage you to review the Terms frequently.
2. ELIGIBILITY
The Services are not targeted toward or intended for use by anyone under the age of 18. By using the Services, you represent and warrant that you:
a) Are 18 years of age or older
b) Are a legal resident of the United States
c) Have not been previously suspended or removed from the Services
d) Have full power and authority to enter into these Terms
3. ORDERING AND COMMUNICATIONS
When you purchase Beef Credits, you agree to:
a) Provide accurate, current, and complete contact information (email, phone, mailing address)
b) Keep your contact information updated by notifying us of any changes
c) Check your email regularly for order confirmations, pickup notifications, and important updates
By purchasing Beef Credits, you consent to receive electronic communications from us via email and text message. These communications may include order confirmations, pickup notifications, and transactional information related to your purchase. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements.
We may also send you promotional communications via email. You may opt out of receiving promotional emails at any time by following the unsubscribe instructions provided therein, but you may not opt out of transactional communications related to your orders
4. LOCAL BEEF CREDIT - HOW OUR SYSTEM WORKS
A. What are Local Beef Club Credits?
Local Beef Club operates on a “Local Beef Club Credits” purchasing model. When you purchase Local Beef Club Credits, you are pre-purchasing products from Local Beef Club, including beef from local farms, ranches, and co-ops, pork, seasonings, and other products we offer. Your purchase is fulfilled by us coordinating with partner farms and suppliers to provide you with the products you ordered.
B. Local Beef Club Credit Offerings
We offer various Local Beef Club Credit packages at different price points. Package options, pricing, quantities, and included products are displayed on our website at the time of purchase and may include:
• Beef packages (various cuts and quantities from local farms)
• Premium cut packages (ribeye, tenderloin, T-bone, etc.)
• Pork products (various cuts and quantities from local farms)
• Specialty bundles (seasonal offerings, holiday roasts, etc.)
• Seasonings, spices, and rubs
• Other products offered through Local Beef Club and www.localbeefclub.com
All offerings are subject to change based on availability, seasonality, and farm partnerships.
Local Beef Club Credits can be redeemed for any products we offer, including beef, pork, seasonings, and other items available at the time of redemption.
C. How It Works
When you purchase Local Beef Club Credits:
1. Your order is placed and payment is processed
2. We batch your order with other customer orders in your region for efficiency
3. We purchase products from our partner farms, ranches, co-ops, and suppliers to fulfill your order
4. Within 4 weeks, your beef is ready for pickup at a designated community location
5. You pick up your beef during our scheduled pickup times (Tuesday 4-6pm or Saturday 10am-2pm)
In most cases, your Local Beef Club Credits are fully redeemed in a single pickup. For larger purchases (such as quarter, half, or whole animal orders that may be offered in the future), you may receive multiple pickups or have a credit balance that can be applied to future purchases. We will track any credit balances on our end and notify you of your available balance. any credit balances on our end and notify you of your available balance.
D. Gift Cards and Transfer
If you purchase Local Beef Club Credits as a gift for someone else, we will provide you with a coupon code that the recipient can use to redeem their Beef Credits. Local Beef Club Credits can be transferred to another person by contacting us at support@localbeefclub.com.
5. FOUNDING MEMBER BENEFITS
Customers who purchase Local Beef Club Credits during our launch phase in their region become "Founding Members" and receive special benefits.
Your Founding Member benefits will be listed on your purchase receipt and order confirmations. Each time a beef pickup is scheduled, you will receive confirmation of your active Founding Member benefits.
Benefits that include the designation "for life" apply to ALL future in-person beef pickups, including:
• Any other products you order from Local Beef Club that require an in-person beef pickup
• Membership and subscription pickups
• Holiday roasts
• Prime rib orders
Founding Member "for life" benefits do NOT apply to products that are shipped directly to you (such as merchandise, accessories, or other items that do not require in-person pickup at our community locations).
Founding Member Status is limited to the first 100 customers per region.
A. Founding Member Terms
• Founding Member benefits apply to the individual or household that made the original purchase
• Benefits are tied to your purchase record in our system and will be confirmed on each order receipt
• Benefits apply to all pickups made by you or authorized household members
• Founding Member benefits may be transferred or gifted to another person with prior approval from Local Beef Club by contacting us at support@localbeefclub.com
• We reserve the right to terminate Founding Member benefits if you violate these Terms or engage in fraudulent activity
• Founding Member benefits are subject to product availability
B. Ground Beef For Life Specifications
• The free ground beef provided with each in-person pickup will be approximately 1 lb
• Weight may vary slightly due to packaging and scale calibration differences (typically between 0.9 - 1.1 lbs)
• Ground beef cannot be substituted for other products (such as steak, ground beef patties, or other cuts)
• Ground beef is provided as-is and reflects our standard ground beef offering
C. Seasoning For Life Specifications
• The free seasoning provided with each in-person pickup will be 1 jar of our standard taco seasoning
• Our seasonings are produced by licensed third-party food manufacturers who maintain all required certifications and food safety standards
• We reserve the right to change seasoning vendors while maintaining equivalent quality and quantity
• Substitutions for other seasonings (such as steak seasoning, roast seasoning, etc.) must be requested in writing at support@localbeefclub.com at least three (3) weeks prior to your scheduled beef pickup
• Seasoning substitution requests are subject to product availability and approval
D. Changes to Founding Member Benefits
• If we substantially change our business model in a way that makes Founding Member "for life" benefits unsustainable, we will provide at least 90 days advance notice and offer reasonable alternatives
• The specific products designated as "for life" benefits may vary by region and launch date, but once granted, your specific "for life" benefits will continue as described on your original purchase receipt
• We reserve the right to change seasoning vendors while maintaining equivalent quality and quantity
• Substitutions for other seasonings (such as steak seasoning, roast seasoning, etc.) must be requested in writing at support@localbeefclub.com at least three (3) weeks prior to your scheduled beef pickup
• Seasoning substitution requests are subject to product availability and approval
6. MEMBERSHIP SUBSCRIPTIONS (OPTIONAL)
In addition to one-time Local Beef Club Credit purchases, we may offer recurring membership subscriptions for customers who want regular, scheduled beef deliveries.
A. Membership Options
Membership subscriptions may be available at various frequencies, including:
• Monthly (every 4 weeks)
• Every 6 weeks
• Every 2 months (bi-monthly)
• Every 3 months (quarterly)
• Every 6 months (semi-annually)
• Annually (once per year)
Not all frequencies may be available at all times. Available membership options will be displayed on our website at the time of enrollment.
B. How Memberships Work
When you enroll in a membership subscription:
• You select your preferred pickup frequency
• Your payment method is charged automatically at the beginning of each billing cycle. An email notice will be sent to you atleast 48 hours prior to this charge.
• Your beef will be ready for pickup on a scheduled Tuesday (4-6pm) or Saturday (10am-2pm) during your pickup period
• You will receive email notification of your scheduled pickup date and location
• Founding Members receive their free 1 lb ground beef and taco seasoning with each membership pickup
C. Memberships Flexibility
Memberships are designed to be flexible:
• You may delay your scheduled pickup by contacting us at least 48 hours in advance
• You may move up your pickup (if available) by contacting us at least 48 hours in advance
• All pickups must occur on a Tuesday (4-6pm) or Saturday (10am-2pm)
• Rescheduled pickups must occur within the same general timeframe of your subscription frequency (we will work with you to find a convenient date)
D. Membership Cancellation
• You may cancel your membership subscription at any time by contacting us at support@localbeefclub.com or through your membership management page (if available)
• Cancellations must be submitted at least 48 hours before your next scheduled billing date to avoid being charged for the next cycle
• If you are charged for a cycle after submitting a timely cancellation, we will issue a full refund
• If you cancel after being charged but before pickup, we will process one final pickup for you
• No refunds will be issued for membership charges after you have picked up your beef for that billing cycle
E. Membership Modifications
• You may change your membership frequency (e.g., from monthly to quarterly) by contacting us at support@localbeefclub.com
• Membership changes will take effect at the start of your next billing cycle
• We reserve the right to modify membership pricing with at least thirty (30) days advance notice
• Price changes will not affect your current billing cycle
F. Missed Membership Pickups
• If you miss your scheduled membership pickup without rescheduling, you must contact us to arrange pickup at the next available Tuesday or Saturday
• Missed pickups do not pause your membership billing cycle (we can easily delay the future orders when needed)
• We are not responsible for product quality issues resulting from delayed pickups due to your unavailability
• If you consistently miss pickups (3 or more in a 12-month period), we reserve the right to cancel your membership
7. PRODUCTS AND SOURCING
A. Our Beef Products
All beef offered through Local Beef Club comes from local farms, ranches co-ops, and suppliers within a reasonable driving distance of your service area. We partner with farms based on customer preferences collected through our survey process.
We offer beef that meets various standards based on what our customers request, which may include:
• Grass-fed, grass-finished beef
• Grass-fed, grain-finished beef
• Certified Organic
We do not source beef from Concentrated Animal Feeding Operations (CAFOs) as defined by the EPA. All partner farms, ranches, and co-ops maintain family-scale operations. While some may finish cattle on grain using feedlots, these operations do not meet the EPA's CAFO thresholds for animal confinement numbers or duration.
When you complete your preferences survey, we match you with beef from farms that align with your selected standards. The specific farming practices for your beef will be communicated to you based on your survey responses and the available farm partners in your region.
B. Quality Standards and Farm Partnerships
Local Beef Club has sole discretion in selecting and maintaining relationships with partner farms, ranches, co-ops and suppliers. We regularly evaluate our farm partnerships to ensure they continue to meet our standards. If a farm partner fails to meet our standards, we will cease working with them and source from alternative farms, ranches, or co-ops that meet our requirements.
C. Product Substitutions
All Products are subject to availability. We reserve the right to:
• Impose quantity limits on any order
• Reject all or part of an order
• Discontinue offering certain products
• Substitute products or cuts without prior notice due to availability
Given the nature of working with local farms, ranches and co-ops and seasonal availability, substitutions may be necessary. If you are not satisfied with a substitution, please contact us at support@localbeefclub.com.
D. Product Variations
You acknowledge that beef products are natural products that vary in size, weight, appearance, and characteristics. Products you receive may differ from photos or descriptions on our Site due to:
• Natural variability of livestock and cuts
• Differences in how your device displays images
• Seasonal variations
• Individual meat processing methods
8. PRICING AND PAYMENT
A. Pricing
All prices are shown in U.S. dollars. Applicable taxes and other charges are additional. We reserve the right to adjust prices at any time; however, any Local Beef Club Credits you have already purchased will be honored at their original redemption value (the amount of beef you're entitled to receive).
B. Payment Methods
We accept payment via credit card, debit card, and other payment methods made available through our payment processors (including Stripe, PayPal, Apple Pay, and Payments AI). By providing a payment method, you:
• Represent that you are authorized to use the designated payment method
• Authorize us (or our payment processor) to charge your payment method for all purchases
• Are responsible for all charges, including applicable taxes
C. Sales Tax
We will collect applicable sales tax on products shipped or made available for pickup in jurisdictions where we determine we have a duty to collect sales tax.
D. Failed Payments
If we cannot obtain authorization for charges to your payment method, or if any amounts are reversed or charged back, we may:
• Cancel your order
• Make subsequent attempts to charge your payment method
• Use other lawful means to collect payment
9. ORDER FULFILLMENT AND PICKUP
A. Order Timeline
When you purchase Local Beef Club Credits, your order will be fulfilled within 4 weeks. We will email you with:
• Your assigned pickup location
• Your scheduled pickup date and time
• Pickup instructions
B. Pickup Schedule
Current pickup times (subject to change by region):
• Tuesday: 4:00-6:00 PM
• Saturday: 10:00 AM - 2:00 PM
Pickup times may vary by location and will be communicated to you in advance.
C. Pickup Locations
Pickup locations may include:
• Neighborhood host homes
• Local gyms and fitness centers
• Community centers
• Parks or other public space
You will be notified of your specific pickup location when your order is ready.
D. Pickup Responsibility
You are responsible for picking up your beef during the designated pickup window. If you cannot make the scheduled pickup:
• Contact us BEFORE your scheduled pickup time
• We will reschedule you for the next available pickup time (Tuesday 4-6pm or Saturday 10am-2pm)
• You are responsible for proper storage once you receive your beef
E. Missed Pickups
If you miss your scheduled pickup without notifying us:
• We will attempt to contact you to reschedule
• Your beef will remain in cold storage if possible
• We will reschedule your pickup for the next available pickup time
• We are not responsible for quality issues if rescheduling causes extended cold storage time
• We reserve the right to cancel your order without refund if you miss multiple scheduled pickups without communication
F. No Shipping
Local Beef Club does not ship beef. All orders must be picked up at designated community pickup locations. This is a core part of our mission to eliminate shipping waste and support local food systems.
10. PRODUCT SAFETY AND HANDLING
A. Your Responsibility
FROM THE TIME OF PICKUP, YOU ARE SOLELY RESPONSIBLE FOR:
• Inspecting meat products upon pickup
• Proper refrigeration and storage
• Safe handling, preparation, and cooking
• Following USDA food safety guidelines (available at www.fsis.usda.gov)
• Knowing your food allergies and verifying product suitability
B. Temperature and Food Safety
You should refrigerate all beef products immediately after pickup. We recommend:
• Following USDA refrigeration guidelines
• Using a food thermometer to verify cooking temperatures
• Following safe food handling practices
• Cooking all beef to USDA-recommended internal temperatures
D. Allergen Warning
Products are processed in facilities that may handle allergens including milk, wheat, egg, soy, fish, shellfish, peanuts, and tree nuts. We cannot guarantee that cross-contamination will not occur.
11. REFUNDS AND REPLACEMENTS
A. Before Fulfillment
You may request a full refund of your Local Beef Club Credits purchase at any time before we have purchased beef from our farm partners on your behalf. Refund requests must be submitted to support@localbeefclub.com.
Once we have purchased beef from farms on your behalf, your order is considered fulfilled and the no-refund policy below applies
B. After Fulfillment (Pickup)
WE ARE SELLING PERISHABLE PRODUCTS AND CANNOT ACCEPT RETURNS ONCE YOU HAVE PICKED UP YOUR MEAT.
However, we want you to be completely satisfied. If you have any quality concerns with your beef, please contact us at support@localbeefclub.com within 7 days of pickup with:
• A description of the issue
• Photos of the product and packaging
• Your order number
We will review your concern and, at our discretion, may offer:
• Replacement product at your next pickup
• Local Beef Club Credits toward your next order
• A partial or full refund
C. What We Cannot Refund
We cannot issue refunds if:
• You did not follow proper food safety and storage guidelines after pickup
• You are simply unsatisfied with natural variations in the product (size, marbling, appearance)
D. Damaged Products at Pickup
If you notice damage or temperature concerns at the time of pickup:
• Do not accept the product
• Notify the pickup coordinator immediately
• Contact us at support@localbeefclub.com within 24 hours with photos
• We will investigate and provide an appropriate replacement or refund
12. CANCELLATIONS
A. Canceling Local Beef Club Credits Before Fulfillment
You may cancel your Local Beef Club Credits purchase and receive a full refund any time, up until 48 hours prior to your scheduled pickup time.
13. WAITLIST DEPOSITS
When we expand to new regions, we may offer a waitlist deposit system:
A. Deposit Terms
• Deposits (amount $1-$100, but fully refundable) reserve your spot as a Founding Member when we launch in your region
• Deposits will be applied as Local Beef Club Credits toward your first purchase when we launch
• Deposits are fully refundable at any time prior to your purchase of Local Beef Club Credits
B. Launch Notification
We cannot issue refunds if:
• We will notify you 30 days before launching in your region
• Launch timelines may take up to two years in some regions
• We will provide regular progress updates on reaching the 100-person threshold in your region
C. Refund Policy for Deposits
You may request a full refund at any time prior to the purchase of your Local Beef Credits. In doing so you will loose the benefits of the founding member status. To request a refund, email support@localbeefclub.com.
14. TRANSFERRING BEEF CREDITS AND FOUNDING MEMBER STATUS
A. Transferring Local Beef Club Credits
You may transfer unused Local Beef Club Credits to another person by contacting us at support@localbeefclub.com. Both you and the recipient must consent to the transfer. Once transferred, Local Beef Club Credits cannot be transferred back.
B. Gifting Local Beef Club Credits
You may purchase Local Beef Club Credits as gifts for others. We will provide you with a coupon code that the recipient can use to redeem their Beef Credits when placing their order.
C. Founding Member Status
Founding Member status and benefits may be transferred or gifted to another person with prior approval from Local Beef Club. Contact us at support@localbeefclub.com to request a transfer. Authorized household members may pick up orders on your behalf and receive the Founding Member benefits associated with your purchases.
D. Moving to a New Service Area
If you move:
• Your Local Beef Club Credits move with you
• If we serve your new area, you can continue using your Beef Credits and Founding Member benefits
• If we do not yet serve your new area, we will:
a) Hold your Local Beef Club Credits until we launch in your new area, OR
b) Issue a refund of your remaining Local Beef Club Credit balance at your request
c) You may leave any deposit amount as Local Beef Club Credits for when we launch in your new area
15. DISPUTE RESOLUTION; ARBITRATION
A. Binding Arbitration
For any dispute arising out of or related to these Terms, the Services, or Products, except for disputes in which either party seeks injunctive relief or disputes that can be brought in small claims court (each, a "Dispute"), you and Local Beef Club agree to:
• Waive your and Local Beef Club's respective rights to have Disputes resolved in court
• Waive your and Local Beef Club's respective rights to a jury trial
• Arbitrate Disputes through binding arbitration
B. No Class Actions
You and Local Beef Club agree that any Dispute is personal to you and Local Beef Club and will be resolved solely through individual arbitration. There will be no class arbitration, class action, or representative proceeding.
C. Arbitration Rules
The arbitration will be conducted in accordance with the rules of the Judicial Arbitration and Mediation Services ("JAMS"), available at www.jamsadr.com. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
D. Notice and Informal Resolution
Before initiating arbitration, you and Local Beef Club agree to attempt to resolve the Dispute informally for at least 30 days. Notice to Local Beef Club must be sent to:

• A description of the Dispute

E. Arbitration Location and Process
Arbitration will be conducted in the county where you reside. The arbitrator will have exclusive authority to resolve the Dispute, including the authority to grant any remedy that would be available in court.
F. Limitation Period
Any Dispute must be commenced within one (1) year of the date the Dispute arose, or it is permanently barred.
G. Opt-Out Right
You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by writing to:

The opt-out notice must include your full name and clearly indicate your intent to opt out of binding arbitration.
16. GOVERNING LAW AND VENUE
These Terms and any Disputes shall be governed by the laws of the State of Montana, without regard to conflict of law principles. Any Dispute not subject to arbitration shall be resolved in the state or federal courts located in Flathead County, Montana.
17. LIMITATIONS OF LIABILITY
A. Disclaimer of Warranties
• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT PRODUCTS WILL MEET YOUR EXPECTATIONS
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY OF PRODUCT DESCRIPTIONS, PRICING, OR NUTRITIONAL INFORMATION
B. No Liability for Farm Products
Local Beef Club facilitates connections between customers and local farms. We are not responsible for:
• The quality, safety, or characteristics of beef produced by partner farms
• Farming practices or animal welfare standards of partner farms (though we select partners carefully)
• Any illness, injury, or damage caused by consumption of beef products
C. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
LOCAL BEEF CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS, THE SERVICES, OR PRODUCTS.
THE MAXIMUM AGGREGATE LIABILITY OF LOCAL BEEF CLUB FOR ANY CLAIMS RELATED TO YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE BEEF CREDITS OR PRODUCTS THAT ARE THE SUBJECT OF THE CLAIM, OR $250, WHICHEVER IS GREATER.
These limitations apply regardless of the legal theory on which your claim is based, including contract, tort, strict liability, or any other theory.
18. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Local Beef Club and our officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to:
• Your use or misuse of the Services or Products
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your failure to follow proper food safety and handling procedures
• Any illness or injury resulting from your handling, preparation, or consumption of Products
19. INTELLECTUAL PROPERTY
A. Our Property
The Services and all content, including text, graphics, logos, images, and software (the "Content") are the property of Local Beef Club or our licensors and are protected by copyright, trademark, and other intellectual property laws.
B. Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Services and Content for personal, non-commercial purposes. You may not:
• Copy, modify, or create derivative works of the Content
• Use the Content for commercial purposes
• Remove any copyright or proprietary notices
• Use any automated means to access the Services
C. Trademarks
"Local Beef Club" and our logo are trademarks of Local Beef Club LLC. You may not use our trademarks without our prior written permission.
20. TERMINATION
We reserve the right to terminate your access to the Services and cancel your Local Beef Club Credits at any time, for any reason or no reason, including if we believe you have violated these Terms.
Upon termination:
• Your access to the Services will be revoked
• Unused Local Beef Club Credits may be refunded at our discretion
• Founding Member benefits will be terminated
• Sections of these Terms that by their nature should survive will continue to apply
21. GENERAL PROVISIONS
A. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Local Beef Club regarding the Services.
B. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
C. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
D. Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
E. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

22. MODIFICATIONS TO SERVICES
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.
23. SURVIVAL
